Welcome to MD Live Advice. MD Live Advice is a health information and physician guidance platform operated by MDZ HR, Inc., an Arizona corporation. Our mission is to make it easier for individuals and families to connect with experienced physicians for trusted medical information, education, and guidance that helps them make informed healthcare decisions.

MD Live Advice provides access to physicians who offer educational discussions and general medical guidance based on the information you choose to share. MD Live Advice does not practice medicine, provide medical treatment, establish physician-patient relationships on its own behalf, or replace the care of your personal healthcare provider. The platform is not intended for emergency medical situations, diagnosis, treatment, prescribing medications, or ongoing medical management.

Because your privacy is fundamental to the trust you place in us, MD Live Advice is committed to protecting your personal information and respecting the confidentiality of your health information. This Privacy Policy explains what information we collect, how we use and safeguard it, when we may share it, and the choices and rights you have regarding your information. We are committed to handling your information responsibly and in accordance with applicable federal and state privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA), where applicable.

HIPAA and Your Protected Health Information (PHI)

This Privacy Policy describes how MD Live Advice collects, uses, and protects your personal information. It does not replace or modify your rights under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") with respect to Protected Health Information ("PHI").

When you use MD Live Advice, you may choose to share health-related information in connection with your conversation with a physician. To the extent that information constitutes PHI under HIPAA, MD Live Advice and its affiliated healthcare professionals will collect, use, maintain, and disclose that information only as permitted or required by HIPAA and other applicable federal and state laws.

MD Live Advice is a health information and physician guidance platform operated by MDZ HR, Inc. While MD Live Advice itself does not practice medicine, physicians using the platform may receive and review information you voluntarily provide to facilitate your discussion and provide educational medical guidance. We collect only the information reasonably necessary to operate the platform, verify your identity, schedule and facilitate your session, process payments, provide customer support, improve our services, and comply with applicable legal and regulatory requirements.

We may share your PHI only with individuals or organizations that require access to perform services on our behalf or to support the delivery of services through the platform, including secure technology providers, payment processors, cloud hosting providers, and other authorized service providers. All such disclosures are made in accordance with HIPAA, applicable privacy laws, and contractual confidentiality obligations.

From time to time, MD Live Advice may utilize artificial intelligence and other automated technologies to assist with administrative functions such as appointment scheduling, documentation support, customer communications, transcription, quality improvement, and platform operations. These technologies operate under appropriate privacy and security safeguards, and any access to Protected Health Information is managed in compliance with HIPAA and applicable law.

If a physician providing services through MD Live Advice maintains records relating to your interaction, your information will be handled in accordance with that physician's Notice of Privacy Practices, where applicable. You have important rights under HIPAA, including the right to request access to your PHI, request corrections, receive an accounting of certain disclosures, request restrictions on certain uses and disclosures, and request confidential communications, subject to applicable law.

If you have questions regarding your Protected Health Information or your privacy rights, please contact our Privacy Officer at support@mdliveadvice.com or by mail at:

We limit the ways that we use sensitive personal information to legitimate internal business purposes, such as: (i) to perform services or providing goods reasonably expected by an average consumer; (ii) to detect and respond to security incidents and malicious, deceptive, or illegal actions; (iii) to ensure the physical safety of individuals; (iv) for short-term, transient use, including non-personalized advertising; (v) to perform or provide internal business services; and (vi) verify or maintain the quality or safety of a service or device. How We May Use the Personal Information We Collect

As MD Live Advice is a newly launched service, our information-sharing practices are evolving as we build and operate our platform. We may share personal information in the following circumstances:

When We Disclose the Personal Information We Collect

MD Live Advice does not sell your personal information for monetary compensation.

As we continue to develop our website and digital services, we may use website analytics tools, cookies, or similar technologies to better understand how visitors use our platform and to improve the user experience. Under the privacy laws of certain states, the use of these technologies may be considered a "sale" or "sharing" of certain information, even though no money is exchanged.

If and when these technologies are implemented, the categories of information that may be shared with analytics providers could include identifiers, device and browser information, internet or other electronic activity information, and approximate (non-precise) geolocation information. Where required by applicable law, MD Live Advice will provide appropriate notice and offer consumers the ability to exercise any applicable privacy rights, including the right to opt out of such sharing.

Cookies, Analytics, and Similar Technologies

MD Live Advice uses cookies and similar technologies to help operate, secure, and improve our website and online services. These technologies allow us to understand how visitors use our platform, maintain website functionality, enhance security, and improve the overall user experience.

As MD Live Advice continues to develop, we may expand our use of these technologies. This Privacy Policy will be updated as our practices evolve.

Cookies

Cookies are small text files that are stored on your computer or mobile device when you visit our website. We may use:

Analytics

We may use website analytics services, including Google Analytics or similar analytics providers, to help us understand how visitors find and use our website. These services may collect information such as your browser type, device information, operating system, pages visited, time spent on pages, referring websites, and general geographic region based on your IP address. This information is generally used in aggregate to improve the performance, usability, accessibility, and content of the MD Live Advice platform.

Google Analytics operates under Google's own privacy policies. You may learn more about Google's privacy practices at https://www.google.com/policies/privacy/partners and may opt out of Google Analytics by installing Google's browser add-on available at https://tools.google.com/dlpage/gaoptout.

Similar Technologies

We may also use technologies such as web beacons, pixel tags, clear GIFs, or similar tools to understand how visitors interact with our website, measure the effectiveness of our communications, monitor website performance, and improve our services.

Managing Cookies

Most web browsers allow you to control or disable cookies through your browser settings. You may choose to block or delete cookies at any time. Please note that disabling certain cookies may affect the functionality, security, or performance of portions of the MD Live Advice website.

Targeted Advertising

At this time, MD Live Advice does not use your Protected Health Information for advertising purposes. If we introduce targeted advertising technologies in the future, we will do so in accordance with applicable privacy laws, provide any required notices, and update this Privacy Policy accordingly.

Behavioral and Targeted Advertising Information

We conduct advertising and content personalization on certain of our Sites and on third-party websites. We may track your activity over time and across properties to develop a profile of your interests and advertise to you based on our interests (which is commonly referred to as “behavioral advertising”). We may also measure the effectiveness of advertising campaigns and our communications with you, including identifying how and when you engage with our emails (such as whether you open an email or click on its content).

Setting your Preferences

We use cookie consent management. When you visit our Services, including our Sites, you can set your cookie preferences using a consent banner. You can change your choices later by clearing your cookies in your browser settings and updating your choice in the consent banner, or by using “Manage Cookie Preferences” to choose certain types of cookies. Note that Required Cookies cannot be turned off, and if you decide to opt-out of Functional Cookies, some features of our Sites may not work properly.

Security

We take steps to protect your personal information using physical and electronic safeguards. However, no electronic transmission or storage is completely secure, and we cannot guarantee the absolute security or privacy of your information.

Retention Of Personal Information

We will keep your information for as long as needed to fulfill the purposes in this Policy, to provide our Services to you, or as you instruct, unless a longer period is required or allowed by law.

Children’s Privacy

We do not knowingly collect, maintain, use, sell, or share personal information (including sensitive personal information) from children under 16 years of age. If you learn that a child has given us personal information in violation of our policy, then please let us know at support@mdliveadvice.com.

Your Privacy Rights

Personal Information and Protected Health Information

The rights described in this section generally apply to personal information that is not regulated as Protected Health Information, or “PHI,” under the Health Insurance Portability and Accountability Act of 1996, commonly known as “HIPAA.”

Some health-related information you provide through MD Live Advice may constitute PHI, depending on how the information is collected, maintained, and used, and on the legal status of the physician or organization receiving it. PHI is governed by HIPAA, applicable state health-privacy laws, and any applicable Notice of Privacy Practices.

Because MD Live Advice may collect both general personal information and health-related information, the laws and procedures that apply to a particular request may differ. A request concerning PHI may need to be processed as a HIPAA request for access, amendment, restriction, confidential communications, or an accounting of disclosures rather than as a general consumer privacy request.

If you are uncertain which rights apply to your information, please contact us at support@mdliveadvice.com. We will review your request and direct it to the appropriate person or process.

Consumer Privacy Rights

Depending on the state in which you reside and subject to applicable exceptions, you may have some or all of the following rights regarding your personal information:

Sale and Sharing of Personal Information

MD Live Advice does not sell personal information for monetary compensation.

As a newly launched service, MD Live Advice may use limited analytics, cookies, pixels, or similar technologies to operate and improve its website. Depending on the technology used and the state in which you reside, certain disclosures to analytics or advertising providers may be defined by law as a “sale,” “sharing,” or use for targeted advertising even when no money is exchanged.

MD Live Advice does not sell PHI and does not use or disclose PHI for targeted advertising except where expressly authorized by the individual and permitted by applicable law.

Where legally required, MD Live Advice will provide a method to opt out of covered sales, sharing, or targeted advertising. This may include a “Manage Cookie Preferences,” “Your Privacy Choices,” or similar link made available through our website.

Global Privacy Control

Where required by applicable law and technically supported by our website, MD Live Advice will recognize qualifying browser-based opt-out preference signals, such as the Global Privacy Control, as a request to opt out of the sale or sharing of personal information associated with that browser or device.

Because these signals are generally browser- and device-specific, you may need to enable the signal on each browser and device you use. We may request additional information when necessary to apply a request to an identifiable account.

Exercising Your Rights

You may submit a privacy request by:

Privacy Officer, MD Live Advice, 2239 E. 5th Street, Tucson, Arizona 85719

Your request should:

Please do not send detailed medical information through an unsecured email. We may provide a secure method for submitting additional information when needed.

MD Live Advice does not currently maintain a separate third-party privacy-request portal or dedicated toll-free privacy number. If those methods are added, this Privacy Policy will be updated accordingly.

Verification of Requests

To protect your information, we may take reasonable steps to verify your identity before completing a request. The verification process will depend on the nature and sensitivity of the information involved.

We will use information provided for verification only for the purpose of verifying and processing the request, preventing fraud, maintaining security, and complying with applicable law.

We may be unable to fulfill a request if we cannot reasonably verify your identity, cannot locate the requested information, or are permitted or required by law to retain or use the information.

Authorized Agents

Where permitted by applicable law, you may designate an authorized agent to submit a privacy request on your behalf. We may require:

An authorized agent may use the same request methods described above.

Appeals

If we deny a request and applicable law provides a right to appeal, you may submit an appeal by emailing support@mdliveadvice.com with the subject line “Privacy Request Appeal.”

Please identify the original request, explain why you believe the decision should be reconsidered, and provide any additional information relevant to the appeal. We will review and respond within the period required by applicable law.

Washington, Nevada, and Other Consumer Health Data Rights

Residents of Washington, Nevada, and other states with consumer health data laws may have additional rights concerning consumer health data that is not regulated as PHI under HIPAA.

These rights may include the right to confirm whether consumer health data is being collected or shared, access or delete such data, withdraw consent, and receive information about certain recipients of the data.

MD Live Advice will provide a separate Consumer Health Data Privacy Notice where required. That notice will describe the categories of consumer health data collected, the purposes for collection, the sources of the data, the categories of recipients, and the methods available to exercise applicable rights.

Communications Consent and FCC Requirements

MD Live Advice may send administrative communications related to account registration, identity verification, requested services, appointments, security, payments, or changes to our policies.

We will obtain any consent required by the Telephone Consumer Protection Act and applicable Federal Communications Commission rules before sending automated or prerecorded marketing calls or promotional text messages.

Consent to receive marketing calls or promotional text messages is not a condition of purchasing or using MD Live Advice services. You may withdraw consent to promotional text messages by replying STOP or by using any other opt-out method identified in the message.

Message and data rates may apply. Message frequency may vary. Reply HELP for assistance where that functionality is available.

Third-Party Services and Links

The MD Live Advice website or platform may contain links to websites, applications, products, or services operated by other organizations. MD Live Advice does not control and is not responsible for the privacy, security, or information practices of those third parties.

A link to a third-party service does not constitute an endorsement of that service. We encourage you to review the privacy policy and terms of each third-party website or service before providing personal or health-related information.

International Visitors

Our Sites are hosted in the United States and intended for visitors in the United States. If you visit our Sites from the European Union or other regions with different data collection and use laws, note that you are transferring your personal information to the United States and other countries where our vendors may be located for storage and processing. By providing any information, including personal information, you consent to such transfer, storage, and processing.

Changes To Our Privacy Policy

We will update this Policy so it accurately reflects our data collection and use practices, changes to our privacy policies, or as required by law. We will follow legal requirements to notify you of material updates by, for example, posting notice to the Services or sending you an email.

Contact Information

If you have any questions, comments, or concerns about our processing activities, please email us at support@mdliveadvice.com.

SMS Communications

If you choose to provide your mobile phone number and actively check the SMS consent checkbox (unchecked by default), MD Live Advice will send you transactional text messages only: appointment confirmations, reminders, schedule changes, account-security codes, and notices that a secure message is waiting in your patient portal. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Consent to receive text messages is not a condition of purchase or of using the service.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
